Key elements of a medical malpractice case

Medical malpractice sometimes leads to significant injuries to a patient who is under a doctor’s care. That patient may believe that the doctor is at fault, and they may want to seek financial compensation for pain and suffering, medical bills, lost wages and much more. 

To do so, there are a few different components to consider. Let us look at how these elements work together to help establish the right to compensation.

The duty of care

First and foremost, it needs to be established that the doctor had a duty of care to the specific patient. Only someone who did have this duty of care can be responsible for the injuries or mistakes that occurred.

Act of negligence

Next, it needs to be shown that the professional was negligent or made certain errors and did not uphold the proper and expected standard of care. An example could be a surgeon who operates on the wrong side of a patient’s body. They did not do it intentionally, but they made a negligent mistake.

Injury to the patient

Next, they need to demonstrate that the error from the medical professional actually caused harm to them as the patient. In addition, they need to demonstrate that the harm they suffered led to financial damages. These could include increased medical bills, lost wages, reduced earning capacity and more.

Seeking compensation
